Job Description:

Role SummaryManage the client facing contract of a power plant service or equipment/ spares supply, during tendering and project execution Support both ITO (Commercial Operations, Sales and Sourcing teams) and OTR (Projects, Construction and Project Sourcing teams) activities by acting as a key member of an ITO and/or OTR team and pursuing a commercially focused and pro-active Contract, Claim and Risk Management culture across GE Power
Essential Responsibilities1 Operational

Support the project execution start-up, prior to full Notice to Proceed (D4), including Contract analysis and preparation of Project Commercial Execution Plan, Contract Commercial Plan,including Project Claim Strategy by ensuring
- That all key obligations and responsibilities of all parties, including customers, partners, vendors and project insurers (if any) as well as GE Power, are analysed and identified and communicated to the Project team at the Project start-up
- That the Projects contract programme/ schedule records on the critical path as far as possible, all major time related activities and the key responsibilities of customers
- That a strong, pro-active but fair claim management philosophy is established and practiced throughout the duration of the project enabling GE Power to pursue claims against and robustly defend and rebut claims from customers, vendors (in a supporting role), external project partners and other parties ; assist the negotiation of favourable commercial settlements thereby avoiding costly disputes and dispute resolution processes
- That events, risks (including those that could cause loss, damage, delay and/or disruption),opportunities, claims, change/variation orders logs and registers are set up and are accurately completed and updated throughout the duration of the Project, all kept in observance of any document retention obligations in the Project contract, relevant policies of GE and/or as may exist at law
- That any dispute with any external party in which resolution will only be achieved by litigation, arbitration, adjudication or any other formal legal process is referred to the GE Power Litigation team

Supporting the preparation of proposals/offers/tenders for project service contracts; reviewing contractual processes relating to payment, claims for change orders / variations, additional costs, extensions of time to schedule, insurances, bonds, delivery/completion etc, analyzing contractual and commercial risks, supporting the risk review process to obtain required approvals on the T&Cs; Reviewing draft project contract and/or sub-contracts and/or consortium documents, confidentiality/NDA agreements, pre-bid agreements etc, and supporting negotiating teams to successfully conclude such matters

2 Functional/transverse

o Lead regional or global initiatives as delegated by management, including the following if delegated to that employee
- Contract Management KPI reporting Coordinate the submission of Contract Management KPI data from all projects
- Answer queries and ensure accuracy and consistency of information
- Experience Return actively participate in Experience Return and regularly seek feedback from CMs and encouraging lawyers and CMs involved in tendering to utilise it effectively
Qualifications/RequirementsTertiary technical qualification in relevant technical discipline, eg quantity surveying, building or engineering
Experience in the construction industry (or production industry for equipment) Experience in Indian PSU Steam Power Projects is desirable
Experience of managing capital asset contracts and claims
Broad and substantive knowledge of legal and contractual principles
Desired CharacteristicsUnderstanding of Technical products and concepts
Experience of high level negotiations
Strong communication skills
Fluency in written and spoken English and project language
Ability to make decisions/ Sense of Urgency
